How Do Courts Assess Living Apart?
The Court evaluates the continuity and reality of the separation. Important considerations include:
- Whether the spouses maintained separate households or routines.
- Evidence of living arrangements—such as tenancy agreements or bills.
- Whether the separation was agreed upon or unilateral.
- If living under the same roof, whether the parties have ceased marital interactions.
Even cohabitation under the same roof can qualify, provided the couple lived separate lives in all other respects.
